And what good is a nascent advertising category without its first big lawsuit, we ask? MocoNews reports that clothing and shoe company Timberland and GSI were subject to a class-action lawsuit that accused them of sending SMS text messages in violation of the U.S. Telephone Consumer Protection Act.
Under the terms of the recently announced settlement—the first of its kind, according to the law firm involved in the case—the two companies will pay $7 million into a cash fund that will reimburse those who received the messages.
The report said that Timberland and GSI are blaming a third-party company that they claim was supposed to ask for consent from the people who received the messages. Anyone who received the text messages can apply for a $150 reimbursement at this link.
